Investors Say They are out Millions and Allege They Have Been Defrauded by Peter Boychyn and his Companies

An Oshawa "businessman" is accused in court filings of being a serial fraudster while his high profile family works to protect him.

Peter Boychyn (44), who previously worked as an excavator under the companies Boychyn Excavating Ltd., and DP Developments Inc., has been charged in multiple fraud incidents that garnered more than $770,000 in funds under a number of schemes.

Peter Boychyn and his businesses have been named as defendants in over 30 civil cases.

Since 2015 Peter Boychyn or his affiliated companies have been named in over 30 civil cases filed at the Oshawa Courthouse and other courthouses in Ontario.

More recently, four civil cases were filed against Peter, DP Development’s and/or his father Donald, alleging fraudulent activities. These lawsuits accuse Peter of convincing investors to help him buy ‘dump tickets’ - tickets to allow the dumping of soil and aggregates on land from local farmers, that would later be resold at huge profits amid pandemic-triggered building supply issues.

Alleged Local Scammer Accused of Fraud

None of the allegations against him or other defendants named in the filings has been proven in court.

Investors were promised returns of as much as 50% on their investments. Some handed over hundreds of thousands of dollars before becoming aware that no ‘dump ticket’ contracts actually existed.

Like Son, Like Father?

According to a source familiar with the situation, Peter’s father, Donald Boychyn, is a prominent lawyer in the Oshawa area and is the brother of former Justice of the Peace and Chair of Durham Regional Police Services Board Robert Boychyn.

Peter isn’t the only one being accused of masterminding the dump ticket proposal. His father, Donald Boychyn an attorney at Boychyn & Boychyn in Oshawa is being sued as well.

They allege that Donald, who was named as the principal director on DP Development’s Inc., was ultimately responsible for the allocation of these funds and was a willing participant in the scheme. According to Peter himself, his father Donald is the one who "truly makes the call on how and when things are paid". Moreover, Donald has been recently been noted in default by an equipment manfucaturer for $260,000, by TD Bank for almost $70,000, has been sued by an automotive dealership for $150,000, and has recently been issued a writ by a mortgage lending company alegging they are owed just over $1,000,000.

“To date, no evidence has been presented to suggest that this dump ticket scheme was in fact real, but rather, the money was simply being used to pay off investors while luring more victims” a source close to the cases said.

Boychyn and others began contacting investors in the spring of 2021 to pitch what he said would be a lucrative business venture, according to statements of a claim filed against him.

The alleged plan was to take advantage of a dumping site shortfall partially sparked by the pandemic. He and others allegedly promised he would be able to purchase ‘dump tickets’ from local farmers at below market value and resell them to construction firms for a substantial mark up.

Investors were promised returns of up to 50% and were pressured to reinvest their profits, according to the lawsuits.

In the beginning, investors would get back some of the promised returns, the statements of claim state.

The venture continued to grow and spread among Boychyn’s associates in Durham Region and the surrounding areas, including multiple business owners and even a law firm.

To complicate matters further, some investors were told that their funds were going towards the purchase of aggregates for resurfacing work to be done at some local businesses and auto lots, however no evidence of any of this work being done seems to exist.

A History of Fraud Allegations

Since 2015 Peter Boychyn, Boychyn Excavating Ltd., and/or DP Developments Inc., have been named in no fewer than 30 different civil cases. Since February 2022 Donald has been named in no fewer than six civil cases.

According to court documents filed in May 2018, an investor was awarded a $3.4 million civil judgement against Peter Boychyn and Boychyn Excavating Ltd.

The documents allege that a business associate invested $2.4M into Boychyn Excavating Ltd for the purchase of heavy equipment and machinery. As part of the agreement Boychyn was expected to have “full rights and legal ownership” of the equipment. The documents allege that this was a fraudulent misrepresentation and in fact Boychyn never had full ownership of said equipment.

A judgement of $3.4M plus interest against Boychyn and his business was brought forth by the presiding judge.

None of the allegations against him or other defendants named in the filings has been proven in court.
